Same as my model magazine articles. The magazine purchases the article to put in their publication but copywrite of pics and the article still belong to me.

So unless the pic was originly his he can't claim copywrite.

I think Bill's comment was tongue in cheek!

Just to quickly recap on the generalities of copyright - for "official" type pics copyright generally subsitsts with the company or government for a set period, usually 50 years from the date of the photograph, but with a privately shot pic, copyright is with the photographer or estate for 50 years after his or her death.
However I stress this is only a generality and it's best to check carefully.
In the case of pictures published on the net, my rule of thumb, based on the fact that there is no commercial use here is to credit the source.
